And at this moment he is suffering together with Mehmet Fazil Aslantürk in a double cell in Istanbul Kartal prison under the stiff isolation conditions…
Yes, he is a detainee…
That means he is an accused…
This means there is not a certain decree about him given by a court…
This is Turkey…
A country where all basic law principles and all human rights are fearlessly violated by an oligarchic dictatorship that seized the power…
This oligarchic dictatorship supposes that the people, who are seen to be “enemies” by it, are slaves with no right and it behaves so…
My client Salih Mirzabeyoglu is one of the top names on the list of “interior enemies” of this oligarchic dictatorship settled in Ankara and he is a direct target who must be destroyed…
There is not any legal support for the lawsuit brought about him… You will see this fact when you read “His Defences” in our site…
“Whether there is any legal support or not” does not matter. In fact, even the concept of “law” alone is a concept that annoys excessively this oligarchic dictatorship in Ankara…
Even they don’t abstain frequently to say words clearly in the meaning of “if law and human rights were not present, we would govern the country finely!”.
Remember the former President Demirel’s remark: “Sometimes the State can depart from the routine”…
Remember the police officers’ illegal manifestation at the streets with the slogan “Down with the human rights”…
And also remember that Mehmet Agar, who can be regarded as one of the masters of torture and illegal execution, was the Justice Minister in this country. It was the same person, Mehmet Agar who said “We applied 1000 covert operations, we crushed the terrorism. Whatever we did was done for our State with the approvals of the National Security Committee (MGK)”, when the 15 thousand murders, that were committed by unknown perpetrators, were mentioned…
Does the State exist in a place where law does not exist? So you are violating the law by the purpose of defense of the State.
These are odd creatures who don’t know and also don’t want to know what is law.
They think that law is “the law”… If they prepared the rules in the direction of their own advantages, everything is okay!…
In such a country we try to carry out the profession of attorneyship, which is a profession whose performance became impossible in such a country…
Defense is one of the basic elements of judgment…
A judgment without defense is equivalent to the lawless execution…
In a situation where defense is not present, you can never mention “the fair judgment”…
In all countries in which law is dominant, attorneyship, “the profession of defense”, is equivalent to the jurisdiction in the aspect of status and security..
But this is Turkey… There is not anything here like that… There is no time to be lost for unnecessary things such as defense, law, justice, fair judgment, independent judgment…
The sharing of the contracts which are adjudicated for billion dollars, narcotic drug commissions, the incomes of imaginary exports and the legitimized illegitimate money among the friends. And the acquaintances have the major priority for it…
So the most important matter for the oligarchy is “the fair sharing of the illegimate incomes”…
For this purpose, they can even realize a coup d’e-tat.
Haven’t they done it?
They can even commit murders!
Where are the killers of the 15.000 dead?
Who are they?
A handful of appointed bureaucrats… A handful of plundering “businessmen”… A handful of greedy politicians… A handful of media employers and their orderly journalists… The total number of them is less than a thousand…
But they do have the power…
They decisively use the extreme power that they seized for their own advantages…
All of them are about 1.000 immoral gang members.
But they seized the power… They rule the population of 65 million as they like.
My client Mirzabeyoglu has shown their true colors and disturbed them with his works… This is what they can’t forgive and accept …
Mirzabeyoًlu, who is one of the most productive thinkers of the Republic, was accused of this…
Because of this, they want to destroy him.
Although there is not a decree given by a court about him he is being subjected to an illegal execution with the words of “Illegal IBDA-C (Islamic Great Eastern Raiders-Front) Leader, the Ringleader of Illegal IBDA-C” by the media that are the horns of the oligarchic dictatorship… All types of disinformation about him are being applied…
Some subtle operations are being applied to lead him to the alternatives of whether to agree to be a robot with no personality or to go mad or to commit suicide…
This is the reason for the presence of this site.
To defend my client who is subjected to a multi-sided, heavy lawless attack!
This site is a part of the defense…
Because, the judgment is not being carried out in the courthouse… It is being carried out at the media… It is being carried out behind the closed doors of the “offices” in which some immune persons work… A perfidiously lawless execution and lynching process are unfairly being operated… As if the oligarchic dictatorship, that lives in the darkness, seemed to leave the duty of destroying my client to the court. But then they gave up and decided to destroy my client by themselves because they have seen that my client’s and our defenses exposed the emptiness of their assertion.
We set up a legal site. Our purpose is to inform the public about Salih Mirzabeyoglu’s judgment process and the realities behind the lawless attacks realized on him.
We believe that this purpose is a part of the struggle for the domination of law in our country and it will contribute to this struggle… For this reason, we expect the contributions and supports of everybody who wants the law to become dominant… After I read my client’s file by the State Security Court (DGM), I remembered a book which I had read 20 years ago, namely “Dreyfüs Case”, by Emile Zola.
Dreyfüs, who is a military officer having Jewish origin, was accused with an assertion that he was a traitor to his country as the result of a conspiracy realized by the “dark state”. He was arrested and depending on the invented evidence he was sentenced. The media which are the loyal servants of the dark state made the public take sides against Dreyfüs by properly managing the duty that was given them. As the result of this successful mediatic lawless execution, all French people believed that Dreyfüs was a traitor… Only his family knew that he was not a traitor but they couldn’t tell anybody about it.
Emile Zola appeared and he started an investigation with the hypothesis that Dreyfüs could not be a traitor.
In the end, he understood that Dreyfüs was not a traitor but a victim of a conspiracy.
The famous author charged himself for defending the rights of an innocent who was supposed to be guilty and started to struggle against this… This struggle, which was started by a single man, became an unpreventable law struggle with the contribution of the French intellectuals and in the end, Dreyfüs obtained his freedom…
In Mirzabeyoglu’s suit file, there are no pieces of evidence even as much as in the Dreyfüs’s suit file…
But He is both imprisoned and under a heavy attack…
I am neither a famous person nor an author..
But my profession is to defend…
I know that my client is innocent in this suit… Because I know the suit file…
For this reason, with this site, I have started a law struggle…
I leave the rest of it to the consciences of the intellectuals who appreciate the value of law..
Emile Zola started his work, ” Dreyfüs Case” with the words “The Truth is walking”…
Yes “The Truth is walking” and it expects your contributions to come to light…
These words also belong to Zola: “I said that the truth was walking and nothing was able to stop it. The first step was taken, the second one will also be taken. Afterward, the other steps; and finally the step which makes us to reach the certain result will come”

ABOUT SALIH MIRZABEYOGLU
Mirzabeyoglu is a thinker and a man of art, who, with his published 41 books, has been a remarkable figure in the intellectual life of Turkey. He is a revolutionary thinker.
Turkey is a country where people are terribly in need of justice (both legal and social); equality in law; freedom; security of life, property, chastity; equality of opportunity; a free society; a government having character; self-culture and self-confidence; a fair distribution of income and social peace. In such a country, people who are aware of the wrong-doings and who think they should take actions in order to correct these wrong-doings, have been affected directly or indirectly by his ideas as the only remedy to solve these problems. Thus, the IBDA MOVEMENT arises.
This revolutionary ideology still keeps up its presence in legal and illegal formations.
Mirzabeyoglu was taken into custody by the police on December 25, 1998, with the assertion that he was the leader of the illegal IBDA-C organization (the Islamic Great Eastern Raiders Front) , detained by the Istanbul State Security Court and imprisoned in Metris Jail. He is being tried at the Istanbul State Security Court Number 6 for “attempting to replace the Secular Constitutional order with Islamic Shariah rules.” He faces the death penalty.
In order to protest his illegal and unjust imprisonment, Mirzabeyoglu has not attended the hearings for a long time.
The government organized a murderous operation into the prison
on January 25, 2000, under cover of taking Mirzabeyoglu for trial. Whereas 4 days before this operation, Mirzabeyoglu and the other 2 defendants had informed the Prison Administration and the Prison Prosecutor about their decision to attend the hearing. Also, Mirzabeyoglu had prepared his defense of about 200 pages, and this had been a complete “book scaled defense”. It was going to be published as his 42nd book.
This murderous Metris Operation has a long story, which also needs to be examined closely.
In this operation, although none of the detainees had shown any resistance or uprising, a gendarme troop, which was specially trained for assassinations in prisons, and which had realized the Ulucanlar Prison raid and massacre in Ankara (in which 11 detainees were killed), stormed the ward where Mirzabeyoglu and other 60 IBDA-C detainees were kept at 4 am on January 25, 2000, without warning or informing them, and threw hundreds of gas bombs and other chemical bombs into the tiny ward from the roof where they were placed.
When the operation was over, Mirzabeyoglu was submitted alive and healthy by the soldiers. Then his hair was cut off and his beard was shaved off, his hands were handcuffed at the back and beaten to death with the intention of lynching. Because of the strokes of kick, fist and butt, he fainted. So, they stopped torturing him thinking that he died.
Because Mirzabeyoglu had practiced boxing in his youth, he has resistance against strokes, and he knows which strokes can cause vital danger. After having got rid of that confusion, he said: “Besides all the insult and swear-words, I got more than 15 kicks on my head. I don’t mention the strokes I got on the other parts of my body. I cannot still understand how I came out from there alive.”
Under these conditions, Mirzabeyoglu was taken from Metris Prison, that smelt blood, gun-powder, chemicals and smoke, and brought to Kartal Prison and put alone in a humid cell of 5 m² in the surveillance division. His hands, his face and all his body were seriously wounded. They tried to break his leg when he fainted. So, this leg was three times thicker than the other one and he was not able to stand on that leg. Due to the strokes he had had, he was frequently fainting. I don’t know whether it is necessary to say or not, but he was not examined by any doctor, he was not given any medicine and his wounds were not dressed.
The Cartel Media, which sniffed the blood, were screaming joyfully:
“Finally the State proved that it was a State”.
In this confusion, even to mention hair and beard seems to be foolish. But probably this situation must be a different fantasy for the sadist Cartel Media that without waiting for the next day to see his final situation, they themselves shaved Mirzabeyoglu on their PCs. This shave was so important for them that they wrote about their fantasy with an exaggeration…
The next day, January, 26.
Under unusual security precautions, Mirzabeyoglu was present at the State Security Court, with his body wildly hurt, his face full of wounds and bruises, his hair cut off and his beard shaved off by the State, with his clothes in blood and mud. It was unbelievable but although he was not able even to stand, the Judge asked for his defense but did not ask who did this to him or how this happened.
After this Law scandal, we, as the Attorney Lawyers, withdrew from the case…
The trial was postponed to February 21 for him to prepare his defense…
The Cartel Media were extremely happy. They wrote: ”He was turned to a plucked hen…”
In a one-person cell in the prison, he started to write his defense again in ill health and wounded situation. With the purpose of destroying the evidence, his book scaled defense was burned by the soldiers who realized the Metris Operation. If they had not burned this defense, it would be understood that there was no acceptable reason for this operation.
On February 21, he read his defense at the court, which he was able to write only for 26 pages under these conditions. When the conditions he was in were considered, I, as a lawyer, can say with a single word that this defense was “marvelous”…
The trial was postponed for two months for him to complete his defense…
AND whatever it was, it happened after this defense…
Some strange situations started to appear…
He started to say that he had difficulties in writing and condensing his thoughts…
He was talking about very interesting events which he experienced in his cell and trying to understand what they could be…
He completed the second part of his defense desperately and gave it to me hastily, and up to the trial day he never looked at it even for correction…
In Kartal Prison in his one-person cell which was designed specially, he was exposed to extreme harassment and torture by means of different ways including the Remote Mind Control Technology, all of which was organized by CIA and a Turkish Intelligence Agency. This period ended in an “attempt for suicide.”
Then, he was transferred to another cell. After this change, the attacks and the torture ended. Now, he is in good health and is working on his 42nd book which tells about the attacks and the torture he lived through.
